These Terms & Conditions govern your access to and use of the Danu Group website, online store, product pages, custom service pages, educational content, messages, invoices, quotations, direct communications, and any related services offered through official Danu Group channels. By accessing the website, making an inquiry, placing an order, paying an invoice, reserving a gemstone, or otherwise engaging with Danu Group, you agree to be bound by these Terms & Conditions.

1. About Danu Group and Official Sales Channels

Danu Group is presented on this website as a Sri Lanka-based gemstone business specializing in natural rough and cut gemstones sourced directly from traditional mining regions, together with related gemstone services and selected jewelry offerings. All product availability, pricing, quotations, invoices, approvals, and sales confirmations are valid only when issued through official Danu Group channels.

Unless Danu Group expressly confirms otherwise in writing, the following are treated as official channels for customer communication and order support:

  • The official website and store pages operated under the Danu Group domain;
  • Official Danu Group email addresses;
  • Official Danu Group WhatsApp / phone communication listed by Danu Group;
  • Official invoices, written quotations, or order confirmations issued by Danu Group.

Danu Group may refuse to recognize or honor payment requests, order instructions, shipping instructions, or pricing messages that do not come through official channels or that appear altered, suspicious, incomplete, or fraudulent.

Important: Social media comments, story replies, temporary chat messages, or informal discussions do not become a binding sale agreement unless the order is later confirmed by Danu Group through an official channel.
2. Acceptance of Orders and Right to Refuse Service

All orders are subject to acceptance by Danu Group. The display of a gemstone, jewelry item, custom concept, service, or educational content on the website does not guarantee availability. Many gemstones are one-of-a-kind natural items and may be sold elsewhere, reserved for another buyer, undergoing certification, being cut or recut, or otherwise unavailable by the time a buyer seeks to purchase them.

Danu Group reserves the right, in its sole discretion and to the extent permitted by law, to:

  • Decline, cancel, pause, or limit any order before shipment;
  • Refuse service where fraud, abuse, unauthorized payment, suspicious conduct, or identity mismatch is reasonably suspected;
  • Request additional identity, address, or payment verification before acceptance;
  • Correct obvious listing errors, description mistakes, image mismatches, technical errors, or pricing errors;
  • Withdraw products or services from sale at any time.

If an order is declined after payment due to unavailability or an issue attributable to Danu Group, Danu Group will arrange an appropriate refund of the amount properly received, less only any non-recoverable charges where this has been clearly agreed in advance or required by law.

3. Eligibility, Buyer Responsibility, and Accuracy of Information

By using the website or placing an order, you represent that the information you provide is true, current, complete, and accurate. You are responsible for ensuring the correctness of your name, billing information, delivery address, phone number, email address, and any country-specific import or courier information required for shipment.

You also agree that:

  • You will not impersonate another person or submit payment information you are not authorized to use;
  • You will not use the website for unlawful, fraudulent, abusive, speculative, or misleading purposes;
  • You are responsible for understanding your local laws regarding import, customs clearance, taxes, duties, restricted items, and delivery rules in your country or region;
  • You will review product descriptions, treatments, certificates, and service terms carefully before making payment.
4. Nature of Natural Gemstones, Variations, and Product Descriptions

Danu Group primarily deals in natural gemstones. Natural gemstones are unique products of nature and are not identical mass-produced goods. As a result, variations in color, tone, saturation, inclusions, zoning, shape, cut style, face-up appearance, brilliance, body color, optical phenomena, and visual personality are normal and expected.

Descriptions, comments, articles, voice-over style narratives, and marketing language are intended to help buyers understand the gemstone better, but they do not eliminate the individual nature of each stone. Unless specifically stated otherwise, product descriptions are given to the best of Danu Group’s knowledge and in accordance with commonly used trade terminology and the documentation available to Danu Group at the time of listing or sale.

Gemstone images, magnified photographs, videos, and close-up content may reveal details that are not visible to the naked eye. Measurements are usually provided in millimeters and weight in carats, which remain the best technical guide to actual size. Buyers should not rely on screen size alone to judge dimensions.

No guarantee of identical appearance on every device: screen settings, mobile displays, monitors, ambient light, camera settings, editing workflow, and background selection can all influence how a gemstone appears online.
5. Treatments, Disclosure, and Gemological Information

Danu Group aims to disclose gemstone treatment information clearly wherever known, documented, or reasonably believed based on available reports, trade knowledge, and inspection. Typical gemstone treatments may include but are not limited to heating, standard heating, low-intensity heating, oiling, filling, diffusion, irradiation, coating, or other accepted or non-accepted trade practices depending on the gemstone species.

Where a product is described as natural/unheated, no treatment, standard heated, traditional heated, or similar, that description is based on the specific report, trade information, laboratory opinion, or informed representation available for that stone at the time of sale.

Buyers acknowledge that:

  • Treatment disclosure is a critical part of gemstone value and must be read carefully before purchase;
  • Not all labs use identical language for the same treatment issue;
  • Origin and treatment opinions are opinions, not guarantees of scientific certainty in every case;
  • Additional testing by another lab may sometimes produce a different wording, interpretation, or opinion.

Danu Group will not knowingly misrepresent treatment status. However, where Danu Group relies on an independent laboratory or third-party documentation, Danu Group is not responsible for differences of scientific opinion between labs, provided that Danu Group has not acted fraudulently or deceptively.

6. Certificates, Laboratory Reports, and Verification

Where a gemstone is sold with a certificate, memo, report, or other laboratory document, that document is issued by an independent gemological laboratory and remains the responsibility of the issuing laboratory as to its own wording, grading style, identification approach, and origin/treatment opinion.

Unless Danu Group expressly states otherwise in writing, certificates are not generated by Danu Group itself. Danu Group may provide scans, photographs, certificate numbers, or copies as part of the sale process, but the content of the report remains the independent laboratory’s opinion.

Where applicable, the buyer is encouraged to:

  • Read the full laboratory report carefully;
  • Verify report numbers on the issuing laboratory’s official system where available;
  • Request clarification before payment if any wording or grading point is unclear;
  • Understand that different laboratories may use different wording, terminology, or thresholds.

If a buyer specifically requests an additional certificate, upgraded laboratory report, special memo, or new testing from another laboratory, the cost, time, and risk allocation for that service will be agreed in advance. Such additional certification services are generally non-refundable once initiated.

7. Photos, Videos, Natural Background Images, and AI Design Previews

Danu Group may publish product images, videos, comparison visuals, macro photography, natural background photography, studio photography, and concept jewelry previews. Some gemstone images may be photographed on natural backgrounds to provide a more realistic sense of the gemstone’s appearance in practical online viewing conditions. Other images may be captured under specialized lighting to reveal color, inclusions, chatoyancy, asterism, fluorescence, color change, or other gemological features more clearly.

Where Danu Group provides AI-generated jewelry concepts, renderings, visualizations, or design previews, those visuals are for inspiration and conceptual planning only unless expressly sold as a finalized physical design specification. Final handmade jewelry may vary in proportion, metal finish, seat height, prong style, diamond size, stone orientation, or other production details.

By purchasing from Danu Group, the buyer acknowledges that:

  • Lighting conditions materially affect gemstone appearance;
  • Videos and photos may show the gemstone under more than one light source;
  • Natural background images are intended to improve realism, not mislead;
  • AI or concept jewelry previews are not binding promises of exact final handmade appearance unless otherwise agreed in writing.
8. Pricing, Currency, Taxes, Duties, and Listing Errors

All prices displayed by Danu Group are subject to change without notice until an order is accepted and payment is confirmed. Unless expressly stated otherwise, prices are shown in the currency identified on the website, quotation, invoice, or payment page.

Where a product page or notice expressly states that the listed price includes shipping, that statement applies only to the shipping scope specifically referenced by Danu Group and does not automatically include every possible tax, duty, brokerage fee, bank fee, customs charge, or destination-country charge.

The buyer is solely responsible for:

  • Any VAT, GST, import duty, customs processing fee, brokerage charge, or similar amount imposed by the destination country;
  • Any currency conversion charges charged by the buyer’s bank, card issuer, or payment provider;
  • Any blockchain network fees, wallet charges, or intermediary transfer fees if an alternative payment method is separately approved in writing.

Danu Group reserves the right to correct pricing errors, duplicate discount errors, coupon abuse, technical glitches, or listing mistakes. If a pricing error materially affects an order, Danu Group may cancel the order and refund the amount received, or offer the buyer the option to reconfirm at the corrected price.

9. Payment Terms, Fraud Prevention, and High-Risk Transactions

Danu Group may accept payment through website checkout, approved card processing, bank transfer, or other payment methods expressly authorized by Danu Group in writing through official channels. No shipment, certification service, cutting service, custom production, or reservation becomes final until the relevant payment has been successfully received and cleared to Danu Group’s satisfaction.

Danu Group may hold, reject, or cancel transactions where any of the following apply:

  • Payment authorization fails or later reverses;
  • Billing and shipping details materially conflict without reasonable explanation;
  • A third party attempts to pay without proper authorization;
  • The transaction appears fraudulent, irregular, sanctioned, or high-risk;
  • A buyer requests that Danu Group use unusual payment paths, unofficial intermediaries, or insecure off-platform transfer arrangements.

If Danu Group permits a temporary stone hold, reservation, or pending status, such hold is discretionary, time-limited, and may expire automatically unless payment is received within the stated period. A hold does not guarantee indefinite availability unless Danu Group expressly agrees otherwise in writing.

Security note: Danu Group may require that payment be made only through direct, verifiable, and officially approved methods. Danu Group may refuse payments involving suspicious third-party exchangers, identity mismatch, or unclear source-of-funds behavior.
10. Shipping, Insurance, Delivery Time, and Tracking

All shipments are arranged after payment is completed. For loose, certified gemstones, international delivery timelines may vary by destination, but Danu Group may discuss estimated timelines such as 5–10 business days for suitable orders where no extra work is required. If cutting, recutting, certification, customization, or special handling is required, the timeline will be discussed and confirmed before proceeding.

Danu Group may use EMS, FedEx, or another appropriate shipping method depending on the destination country, local regulations, courier availability, the nature of the item, insurance considerations, and buyer preference where possible.

Unless otherwise agreed, shipping terms include the following:

  • Danu Group will aim to pack items securely and professionally;
  • Tracking information will be provided once available;
  • Insurance may be included or arranged according to the shipping method chosen;
  • Estimated delivery times are estimates only, not guaranteed delivery promises;
  • Carrier delays, weather events, customs holds, airport delays, strikes, government actions, inaccurate addresses, and similar events are outside Danu Group’s reasonable control.

The buyer is responsible for ensuring that someone is available to receive the parcel where required, and for following local courier instructions. Delivery failure caused by incorrect address information, refusal to cooperate with customs or courier requirements, or failure to collect the parcel may result in additional charges.

11. Customs, Import Rules, and International Buyer Responsibilities

International buyers are solely responsible for understanding and complying with their local customs, import, currency, tax, and product laws before placing an order. Danu Group may prepare invoices and shipment documentation based on the buyer’s instructions and the information provided by the buyer, but Danu Group does not guarantee that any shipment will be cleared automatically under the laws of the buyer’s country.

By placing an international order, the buyer agrees that:

  • The buyer is responsible for import duties, taxes, customs declarations, brokerage charges, and local compliance requirements;
  • The buyer must supply accurate receiver information and any documents reasonably required for customs clearance;
  • Danu Group is not responsible for customs delays, destination seizures, or import refusal caused by destination-country rules or buyer non-compliance;
  • If a parcel is returned due to customs refusal, non-payment of taxes/duties, non-collection, or buyer-side compliance failure, Danu Group may deduct actual shipping, insurance, payment processing, storage, return, and administrative costs from any refund otherwise due.
12. Inspection on Delivery, Damaged Parcels, and Buyer Care Obligations

Immediately upon delivery, the buyer should inspect the external package before acceptance where possible. If the parcel appears damaged, tampered with, torn, crushed, opened, resealed, or otherwise suspicious, the buyer should not quietly accept it without record. The buyer should report visible damage to the courier, document the condition with clear photographs, and notify Danu Group promptly.

After delivery, the buyer is responsible for the item’s value and care while it remains in the buyer’s possession. During any inspection or return window, the buyer must store and handle the item carefully and must not set, alter, scratch, chip, fracture, recut, treat, engrave, resize, weigh differently, or otherwise modify the item if the buyer intends to preserve return rights.

For loose gemstones, Danu Group strongly recommends that buyers do not set the stone with another jeweler until the buyer has fully decided to keep it and any applicable return window has expired.
13. Returns, Refunds, Exchanges, and Non-Refundable Charges

Danu Group’s return and refund rights depend on the item type, its condition, the services performed, and the terms stated at or before sale. Unless Danu Group expressly agrees otherwise in writing, the following framework applies:

13.1 Loose Gemstones

Loose gemstones may be eligible for return within 14 days of delivery, provided all return conditions are satisfied. Eligibility requires that the gemstone is returned in its original, unused, unaltered condition together with the original packaging, original or copy invoice, original product certificate, supporting documentation, laboratory report(s), and any accompanying items originally supplied with the shipment.

13.2 Return Conditions

  • The gemstone must not have been set, scratched, chipped, fractured, resized, recut, treated, cleaned in an aggressive manner, weighed differently, or altered in any way;
  • The gemstone must remain in original condition as sent;
  • Danu Group may inspect and, where necessary, test the returned item to confirm identity and condition before approving a refund;
  • Return authorization from Danu Group must be obtained before the buyer ships the return;
  • The buyer must use a reputable insured courier and provide tracking.

13.3 Non-Refundable Charges

Unless required otherwise by law or expressly agreed otherwise in writing, the following are non-refundable:

  • Original shipping charges;
  • Return shipping charges;
  • VAT, GST, duties, and destination-country customs charges;
  • Payment gateway fees, bank fees, wire charges, currency conversion fees, and similar transaction charges;
  • Extra laboratory certificates, special memo reports, expedited testing, custom-cutting charges, recutting fees, custom jewelry services, special sourcing costs, and other buyer-requested services once performed or initiated.

13.4 Final Sale / Non-Returnable Items

Unless Danu Group expressly agrees otherwise in writing, the following are generally final sale or non-returnable:

  • Custom jewelry, bespoke jewelry, made-to-order pieces, resized rings, engraved pieces, and modified settings;
  • Gemstones that have been cut, recut, repolished, certified, re-certified, reserved for extended periods for the buyer, or otherwise specially processed at the buyer’s request;
  • Items returned in altered, worn, damaged, or incomplete condition;
  • Trade parcels, wholesale parcels, special pricing parcels, or business-to-business sales where final-sale terms were clearly stated in writing.

13.5 Return Shipping Safety

For security, the buyer should not write “gemstones,” “jewelry,” or similar high-risk terms on the outside of a return parcel. The buyer remains responsible for the returned item until Danu Group receives it.

14. Custom Cutting, Recutting, Certification Services, and Jewelry Orders

Danu Group may offer cutting, recutting, certification coordination, design assistance, or custom jewelry services depending on the stone and production capacity. These services are highly case-specific because gemstones are unique and results depend on the natural structure of the stone.

Before such work begins, Danu Group may discuss expected outcomes, possible risks, weight retention considerations, estimated dimensions, certificate pathways, approximate timing, and service pricing. However, the buyer acknowledges that gemstone work cannot guarantee exact final yield, exact face-up look, or exact color outcome.

By requesting cutting, recutting, or custom jewelry work, the buyer agrees that:

  • Natural gemstone work is inherently risk-sensitive;
  • Actual finished results may differ from early estimates or concept discussions;
  • Any approved work may make the item non-returnable or subject to reduced return rights;
  • Production timelines may change due to stone behavior, technical findings, lab timelines, or supply constraints.

Danu Group will not begin materially chargeable work without the buyer’s approval, but once buyer-approved work has begun, related costs may become non-refundable.

15. Ring Sizes, Settings, and Buyer Design Responsibility

If a buyer requests a ring, pendant, or other jewelry piece, the buyer is responsible for providing accurate sizing, metal preference, and any other design instructions requested by Danu Group. If the buyer provides an incorrect size or later changes the design after approval, additional costs, delays, or reduced return rights may apply.

Where Danu Group provides renders, sketches, CAD images, wax previews, or AI-generated design concepts, those materials are guides only unless expressly approved as final production specifications. Handmade jewelry can vary slightly from digital concepts in scale, prong angle, diamond calibration, metal finish, side profile, or other production details.

Unless otherwise agreed in writing, custom settings and specially made jewelry are not returnable merely because the buyer changes personal preference after production has started or been completed.

16. Astrology, Birthstone, Chakra, Symbolic, and Educational Content Disclaimer

Danu Group may provide educational or cultural content relating to birthstones, zodiac associations, symbolic meanings, chakra references, spiritual traditions, historical beliefs, and gemstone folklore. Such content is offered for cultural, artistic, heritage, storytelling, or informational interest only.

That content does not constitute medical advice, mental health advice, religious instruction, financial advice, investment advice, legal advice, or guaranteed personal outcome. Any astrological or symbolic interpretation is belief-based and may vary by tradition, practitioner, region, or personal viewpoint.

By using the website, you agree that purchasing a gemstone based on symbolic or astrological content is a personal choice and that Danu Group does not guarantee any metaphysical, spiritual, healing, relationship, wealth, career, or luck-related result.

17. No Investment Advice and No Guaranteed Appreciation

Unless Danu Group expressly states otherwise in a separate written agreement, no product description, article, blog post, social media post, or private communication should be understood as guaranteed investment advice or as a promise that a gemstone will appreciate in value, resell at a profit, or achieve any future price level.

Gemstone prices depend on many factors outside Danu Group’s control, including market demand, treatment disclosure, changing laboratory opinions, auction conditions, economic factors, fashion trends, liquidity, and the buyer’s own resale channels.

18. Intellectual Property, Site Use, and Content Restrictions

Unless otherwise stated, Danu Group and/or its licensors own or control the intellectual property rights in the website design, text, copy, descriptions, product images, videos, graphics, icons, branding, logos, educational articles, layouts, and other website content. All such rights are reserved.

You may access and use the website for your own lawful personal or internal business review purposes only. You may not, without prior written permission from Danu Group:

  • Republish, scrape, copy, distribute, or commercially exploit website content;
  • Use product images, videos, or descriptions in a misleading or deceptive way;
  • Remove watermarks, branding, notices, or source references;
  • Use Danu Group content to impersonate Danu Group or to mislead buyers about origin, ownership, or authorization;

19. User Comments, Reviews, and Public Interactions

To the maximum extent permitted by applicable law, Danu Group shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss, including loss of profit, loss of resale opportunity, loss of reputation, loss of data, or business interruption arising out of or related to the website, a product, a delay, customs issues, carrier issues, certificate opinion differences, third-party laboratory actions, or buyer misuse of a gemstone or jewelry item.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, or any liability that must be borne under mandatory consumer protection law where applicable.

Where liability cannot be excluded but can be limited, Danu Group’s aggregate liability shall, to the extent permitted by law, be limited to the amount actually paid by the buyer to Danu Group for the specific item or service giving rise to the claim.

21. Disclaimer of Warranties

Except as expressly stated in writing, the website, content, and products are provided on an “as is” and “as available” basis. Danu Group does not warrant that the website will always be uninterrupted, error-free, secure, or free from technical issues. Danu Group also does not warrant that every gemstone will match a buyer’s subjective taste, device-based color expectation, or private resale expectation.

Any warranty or guarantee regarding a gemstone or jewelry item must be expressly stated in writing by Danu Group to be binding.

22. Force Majeure

Danu Group shall not be responsible for delay or non-performance caused by events beyond its reasonable control, including but not limited to acts of God, weather disruption, flood, fire, government action, customs intervention, strikes, embargoes, transport disruption, war, civil disturbance, carrier interruption, telecommunications failure, cyber incident, epidemic, pandemic, or inability to obtain necessary materials or services despite reasonable efforts.

23. Chargebacks, Payment Disputes, and Collections

If a buyer initiates a chargeback, reversal, or payment dispute without valid basis after receiving an item or service, Danu Group reserves the right to provide supporting records to the payment provider, card scheme, bank, platform, or court, and to suspend future service to the buyer.

If a chargeback is reversed in Danu Group’s favor, the buyer remains responsible for any lawful costs, handling charges, or recovery expenses reasonably incurred as a result of the improper dispute, to the extent permitted by law.

24. Privacy, Cookies, and Data Handling

Your use of the website is also subject to Danu Group’s Privacy Policy and cookie practices. By using the website, you acknowledge that Danu Group may use cookies and similar technologies to operate the site, improve functionality, and support the user experience in accordance with its stated privacy practices.

25. Governing Law and Dispute Resolution

If a dispute is not resolved through direct communication within a reasonable period, either party may pursue the matter before the competent courts of Sri Lanka, unless Danu Group agrees in writing to another dispute forum.

Danu Group may revise these Terms & Conditions from time to time by publishing an updated version on the website. The version in effect at the time of your order will generally apply to that order unless the law requires otherwise or both parties agree otherwise in writing.
